1) Bending the toothpicks is not forbidden.
2) Triangles are not defined to exclude equilateral triangles with 2 toothpicks and an imaginary side.

Your point, if you indeed do have one, is over-stated. But you gain sympathy for another anonymous poster, Harv, so maybe you know what you're doing.
